    The party that agrees to the terms and conditions listed below and provides their signature, vows to abide by the agreements contained herein and intend to be legally bound hereby. The Parties do agree to the following terms and conditions, 1. The Purchaser hereby engages Charlotte Photo Booth Fun to provide a rental service. The service to be set up at said event location/venue listed on the reservation form. The said Rental Service shall consist primarily of providing equipment for rental uses. 2. *All venues, address or locations must have access to a ramp for the photo booth to be wheeled in. All locations that require setup on a second floor, must have elevator access. 3. A 10′ X 10′ area is required for proper photo booth setup. If not enough space is provided, the photo booth will not be able to properly be setup and used. 4. A table with a linen must be provide by the purchaser for the props. 5. The Parties hereby agree that the rental service shall be provided and accepted on the dates and times listed on the reservation form. 6. Any missing or damaged props will be charged the replacement cost value, to the purchaser. 7. The purchaser is responsible to pay a fee for any physical damage done to the photo booth. The fee will be assessed based on the cost to repair the damage that was done to the photo booth. 8. The Purchaser in consideration of the rental service to be rendered and the mutual promises contained herein, hereby agrees to pay Charlotte Photo Booth Fun the rental price stated on the reservation form 9. Charlotte Photo Booth Fun will arrive 60 minutes before the specified start time, to begin setup. For every one hour in advance the purchaser would like the photo booth setup (but not functional), there will be a $50 fee. 10. The photo booth is a mechanical, technological piece of equipment. If for whatever reason the booth stops working due to a malfunction, Charlotte Photo Booth Fun will not be held responsible. Charlotte Photo Booth Fun will do its best to rectify the situation. 11. If the photo booth stops working due to improper use or abuse by the purchaser or purchaser’s guests, there will be a pro-rated refund for the remaining time of the rental. 12. Charlotte Photo Booth Fun owns the copyrights to all of the photos and may use them at their discretion for marketing material. 13. Your rental ends at the specified time frame outlined in the photo booth booking form. At the time in which the rental commences, Charlotte Photo Booth Fun will begin the breakdown of the photo booth, even if the event has not yet ended. If the purchaser would like the photo booth to remain setup until the end of the event, but not operational, a fee of $25 will be assessed per every additional one hour of time in excess to the specified rental end time. If the purchaser would like the photo booth to remain up, until the end of the event and in use, a fee of $100 will be assessed per every additional hour in excess to the specified rental time. 14. Charlotte Photo Booth Fun hereby agrees to render their services before and after the event to set up and tare down the equipment. 15. Photo Booth photos will be sent via a flash drive to the billing address listed, unless another address is noted by the customer. 16. Photos will be held on file for 2 months after the event. After the 2 months, all photos will be deleted. Any requests for duplicates must be done within the 2 months. 17. Photos can take anywhere from 2-4 weeks to be delivered (For editing and processing reasons). Photos will not be delivered if the remaining balance was not collected. Additional Terms and Conditions The agreement of the rental service is subject to proven detention by accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions beyond their control. If such circumstances arise, all reasonable efforts will be made by Charlotte Photo Booth Fun to find a replacement rental at the agreed upon fees. Should Charlotte Photo Booth Fun be unable to procure a replacement, Purchaser shall receive a full refund of their reservation fee. Purchaser agrees that in all circumstances, Charlotte Photo Booth Fun liability shall be exclusively limited to an amount equal to the reservation fee and that Charlotte Photo Booth Fun shall not be liable for indirect or consequential damages arising from any breach of contract. Cancellation Policy: If the rental is canceled anytime outside of 90 days from the specified rental date, the purchaser shall be refunded the deposit. If the rental is canceled within 90 days or less from the specified rental date, the purchaser will not be refunded the deposit and will be required be to pay the remaining balance. The purchaser and Charlotte Photo Booth Fun agrees that this contract is not subject to cancellation unless both parties have agreed to such cancellation. In the event the Purchaser breaches the contract, he or she shall pay Charlotte Photo Booth Fun the amount in which Charlotte Photo Booth Fun incurs in damages or expenses. It is understood that this is a “Rain or Shine” event, Charlotte Photo Booth Fun compensation is in no way affected by inclement weather. For outdoor performances, Purchaser shall provide overhead shelter for setup area. No guarantee is made as to Charlotte Photo Booth Fun time of arrival; however, Charlotte Photo Booth Fun requests that they be permitted at least 1 hour before the engagement and at least 1hour after the engagement for setup and takedown. If Purchaser or venue requires Charlotte Photo Booth Fun to complete setup more than one hour before the start time, or to postpone takedown more than one hour after the end time indicated, the additional time will be charged at the rate of $75.00 / hour. The purchaser shall provide Charlotte Photo Booth Fun with a 15-20-amp circuit outlet from a reliable power source (along the wall) of the set-up area. This circuit must be free of all other connected loads. Any delay in the performance or damage to Charlotte Photo Booth Fun equipment due to improper power is the responsibility of the purchaser. A four foot or longer banquet table is needed for the props to be setup which is to be provided by the purchaser. If Charlotte Photo Booth Fun is required to provide the table the purchaser will be charged an additional $50. Purchaser is responsible for paying any charges imposed by the venue. These charges may include, but are not limited to, parking, use of electric power, internet, table, etc. In the event of non-payment, By Request Charlotte Photo Booth Fun retains the right to attempt collection through the courts. Purchaser will be held responsible for all court fees, legal fees, and collection costs incurred by Charlotte Photo Booth Fun. Purchaser shall be charged $30 for each bounced check plus a $10 service charge for each collection notice. By executing this contract as Purchaser, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he or she is eighteen (18) years of age, and further, if executing said contract as agent or representative, that he or she has the authority to enter into this agreement and should he or she not have such authority, he or she personally accepts and assumes full responsibility and liability under the terms of this contract. All attached riders are an integral part of this contract. This contract will supersede any other contract. If any part of this contract is illegal or unenforceable, the remaining provisions of this contract will remain valid and enforceable to both parties. This contract contains the entire agreement between the parties and no statement, promises, or inducements made by any party hereto, or agent or representative or either party hereto, which are not contained in this written contract, shall be valid or binding. This contract shall not be enlarged, modified, or altered except in writing by both parties and endorsed hereon. The law of the State of North Carolina shall govern this agreement. In the event of suit involving or relating to this agreement, the Purchaser agrees to defend, indemnify, assume liability for and hold Charlotte Photo Booth Funs Service harmless from any claims, damages, losses and expenses by or to any person, regardless of the basis, which pertains directly or indirectly to Charlotte Photo Booth Fun performance. Purchaser may not transfer this contract to another party without the prior written consent of Charlotte Photo Booth Fun. This agreement is not binding until signed by the Purchaser. Any changes must be written and signed by both the Purchaser and by Charlotte Photo Booth Fun. Oral agreements are non-binding. If any clause in this agreement is found to be illegal, the rest of the agreement shall remain in force. The parties hereto promise to abide by the terms of this agreement and intend to be legally bound thereby.
